Legal
Terms of Service
These are the rules for using Vaya - the app and website. They are written to be read. By creating an account or booking a trip you accept them. The Privacy Policy explains what happens to your data; the Legal Notice says who is behind Vaya.
1. What Vaya is
Vaya is a booking platform. It connects people who need a taxi in Torrevieja and the surrounding area with licensed taxi licence holders and their drivers, and - where the fleet has switched it on - handles card payment on the licence holder's behalf.
The transport itself is provided by the licence holder whose taxi you ride in. That is who you have the transport contract with, who carries the legal insurance for the journey, and in whose name any factura is issued. Vaya operates the app that brings you together and keeps the record of the trip.
During the current pilot phase Vaya is operated by Corvus Reach (see the Legal Notice). If operation is handed to a taxi fleet company, these terms will say so and you will be told.
2. Your account
You must be at least 14 years old to create an account, and the details you give must be yours and accurate. One account per person. A phone number is needed before your first booking, so the driver can reach you at the pickup.
Keep your sign-in details to yourself. Drivers, fleet owners and call-centre operators must use two-step sign-in. If you think someone else has access to your account, change your password in Settings and write to us.
We can suspend or close an account that is used for fraud, abuse of drivers or riders, repeated no-shows, or anything unlawful. Riders can delete their own account in Settings at any time.
3. Booking, cancelling and not showing up
A booking request is an offer. A trip is confirmed the moment a driver accepts it - you see the driver, the vehicle and the plate in the app from then on.
Cancelling is free while the app is still looking for a driver or the driver has not yet accepted.
Once a driver has accepted and is on the way, or the trip has started, cancelling costs EUR 6: EUR 4 goes to the driver for the journey already made, EUR 2 to the platform. If you pay by card it is charged to your card; otherwise it is recorded against your account and settled with your fleet.
No-show: if the driver has waited at the pickup for at least 5 minutes and you do not appear or answer, the driver can close the trip as a no-show. The same EUR 6 applies.
A driver cancelling never costs you anything. It is recorded on the driver's side (see section 6).
Trips to or from the airport are booked at the published flat rate and cannot carry extra stops.
4. Fares
Fares follow the official municipal taxi tariff of Torrevieja approved by the ayuntamiento, including its day and night rates and waiting time. Airport journeys use the published flat rate, plus the pickup-zone supplement where the tariff applies one.
Before you book, the app shows an estimate based on the route. The amount you pay is what the taximeter reads at the end of the trip. The driver can correct the app's figure to the meter reading; both figures are kept and shown on your receipt, and corrections stay within fixed bounds.
If you believe a fare was wrong, use Settings > Help with the trip reference and we will look at it with the fleet.
5. Paying
You can pay the driver directly, or - where the fleet accepts it - by card in the app. Card payments are processed by Stripe; we never see your card number (see the Privacy Policy).
When you pay by card, the fare is charged when the driver finishes the trip. If your card is declined you can choose another card, add a new one, or pay the driver. A trip is never charged twice.
Tips are optional and go entirely to the driver. A card tip starts at EUR 0,50; a cash tip is yours to hand over.
You get a receipt for every trip in the app. If you need a factura, you can request one; it is issued in the licence holder's name with the billing details you provide.
6. Riders, drivers and fleets
Riders: be at the pickup you chose, give the real passenger count, treat the driver and the vehicle with respect, and do not use Vaya for anything unlawful. Chat and calls through the app are for the trip only.
Drivers and licence holders: you must hold a valid taxi licence and driver ID card (tarjeta identificativa), keep the vehicle legally insured, and charge the official tariff. Only one driver per licence can be on duty at a time. Cancelling a trip after accepting it is recorded as a strike, visible to your fleet owner. Fares settle to the licence holder; tips belong to the driver.
Fleet owners: you are responsible for approving your drivers, keeping their documents current, and for the facturas Vaya issues in your name when you switch that on.
7. Availability and liability
Vaya is in a pilot phase. We work to keep it available and correct, but we cannot promise a driver will always be available, or that the app will never have a fault. We will tell you in the app when we know something is wrong.
The journey, its safety and its insurance are the licence holder's responsibility, as with any taxi. Vaya is responsible for the app: the booking, the record of the trip, and - where enabled - taking the payment correctly.
Nothing in these terms limits any right you have as a consumer under Spanish or EU law, or any liability that the law does not allow to be limited.
8. Changes and ending
We may update these terms. If a change matters, we will say so in the app before it takes effect and ask you to accept it again where the law requires. The version date is shown below.
You can stop using Vaya at any time. Riders can delete their account in Settings; trip and invoice records that the law requires are kept as the Privacy Policy describes.
9. Law, disputes and contact
These terms are governed by Spanish law. If you are a consumer, the courts of your place of residence have jurisdiction. You can also use the European Commission's online dispute resolution platform (ec.europa.eu/consumers/odr) or the consumer arbitration system in your region.
